The Financial Conduct Authority has confirmed that four legal challenges have been filed against its motor finance compensation scheme, potentially delaying payments to affected drivers across Britain.
The compensation programme, announced in March, covers more than 12 million car finance agreements and addresses a mis-selling scandal where motorists paid higher rates without being informed that lenders and banks were receiving additional commissions from these arrangements. The FCA has calculated that eligible drivers could receive an average payout of £829 per agreement, with the total cost to financial institutions estimated at approximately £9.1 billion.
The regulatory body stated it would “robustly defend” the scheme against the legal challenges, though it has not disclosed which organisations have filed the complaints or provided specific details about the nature of their objections. The scheme was designed to provide redress for consumers who were charged discretionary commission arrangements without proper disclosure, a practice the FCA determined was widespread across the motor finance industry.
The compensation covers various types of car finance deals, including hire purchase and personal contract purchase agreements, where brokers and dealers received commission payments that were not transparently disclosed to customers. These arrangements often resulted in higher borrowing costs for consumers who remained unaware of the additional fees being generated from their finance agreements.
The legal challenges represent a significant development that could affect the timeline for distributing compensation to millions of British drivers who took out car finance deals during the relevant period.
